INFORMATION ON THE PROCESSING OF PERSONAL DATA

BASIC SUMMARY

Kolorky.cz s.r.o. processes your personal data because it is necessary for the performance of a contract with you, concerning the sale of goods (or in order to take steps requested prior to entering into such contract). Kolorky.cz s.r.o. also processes your personal data as it is necessary for compliance with the company's public-law obligations.

1. IDENTITY AND CONTACT DETAILS OF THE CONTROLLER

1.1. The Controller of your personal data is the following company: Kolorky.cz s.r.o. with its registered office at Plzeňská 697, Stříbro, 349 01, Company ID: 05591619, VAT No.: CZ 05591619, registered in the Commercial Register held at the Krajský soud v Plzni (Regional Court in Plzeň), Section C, Entry No. 33534 (hereinafter referred to as the ‘Controller’).

1.3. The Controller has not appointed a Data Protection Officer.

2. LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA

2.1. The legal basis for the processing of your personal data consists of the fact that such processing is necessary for:

2.1.1. the performance of a contract between you and the Controller or in order for the Controller to take steps prior to entering into a contract within the meaning of Art. 6(1)(b) of the Regulation (EU) No. 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the ‘Regulation’);

2.1.2. compliance with a legal obligation to witch the Controller is subject within the meaning of Art. 6(1)(c) of the Directive, namely in particular, compliance with obligations imposed on the Controller by general binding legislation, in particular Czech Act No. 235/2004 Coll., on value added tax, as amended, Czech Act No. 586/1992 Coll., on income taxes, as amended, and Czech Act No. 563/1991 Coll., on accounting, as amended.

3. PURPOSE OF THE PROCESSING OF PERSONAL DATA

3.1. The purpose of processing your personal data is to perform a contract between you and the Controller, including the delivery of goods and the resolution of liability rights arising from defects, or taking steps by the Controller prior to entering into such contract, as well as the performance of related public-law obligations by the Controller.

3.2. No automated individual decision-making by the Controller within the meaning of Art. 22 of the Regulation takes place.

4. DURATION OF THE STORAGE OF PERSONAL DATA

4.1. Your personal data will be processed for the duration of the effects of the rights and obligations under the contract and for the period necessary for the purposes of archiving according to applicable general binding legislation, but for a maximum period stipulated by general binding legislation.

5. OTHER RECIPIENTS OF PERSONAL DATA

5.1. Other recipients of your personal data will include shipping companies and persons involved in the delivery of goods or in the execution of payments under a purchase contract, which are, according to the mode of transport you choose, the following:

Městský soud v Praze (Municipality Court in Prague), Section C, Entry No. 245854.

5.3. In addition, the recipients of your personal data processed for the purpose of compliance with legal obligations may include the authorities of the financial administration or other competent authorities where it is imposed on the Controller by general binding legislation.

5.4. The Controller does not intend to transfer your personal data to a third country (non-EU country) or to an international organization.

6. RIGHTS OF THE DATA SUBJECT

6.1. Subject to the conditions laid down in the Regulation, you have the right to request access to your personal data from the Controller, the right to have your personal data rectified or deleted, or to restrict their processing, to object to the processing of your personal data and right to the portability of your personal data.

6.2. If you believe that the Regulation has been or is being violated by the processing of your personal data, you have, among other things, the right to lodge a complaint with the supervisory authority.

6.3. You are not required to provide your personal data. The provision of your personal data is a necessary requirement for entering into and the performance of a contract and without providing your personal data it is not possible to enter into a contract, or for the Controller to perform it.
